This peer review covers Papua New Guinea’s implementation of the BEPS Action 5 transparency framework for the year 2018. The report has four parts, each relating to a key part of the ToR. Each part is discussed in turn. A summary of recommendations is included at the end of this report.

This report is Papua New Guinea’s first annual peer review report. Consistent with the agreed methodology this report covers: (i) the domestic legal and administrative framework, (ii) the exchange of information framework as well as (iii) the appropriate use of CbC reports. The filing obligation for a CbC report in Papua New Guinea applies to reporting fiscal years commencing on or after 1 January 2017. Papua New Guinea also allows its MNE groups to file a CbC report on a voluntary basis for reporting fiscal years beginning between 1 January 2016 and 31 December 2016.http://irc.gov.pg/wp-content/uploads/2017/07/SBg09dc217010615340.pdf.

Papua New Guinea (PNG) acceded to the UNCAC in July 2007. It has been a member of the APG since 2008. PNG’s legal system is based on English common law. Its criminal bribery offences have not been externally reviewed. However, PNG’s implementation of UNCAC (Chapters III and IV) will be reviewed in the first phase of the new UNCAC Review Mechanism.

Papua New Guinea is home to a number of different clans and tribes whose kinship ties determine the manner of relations between people. In general, women lack equal access to education and lag behind men in terms of employment opportunities. Violence against women is common, and is exacerbated by widespread poverty.
