Defending the Commission final investigation

The final injury determination by the International Trade Commission is the last, and perhaps best, chance for the foreign company to end the anti-dumping or countervailing duty investigation. Because the legal standard changes, and the domestic industry must now actually prove that imports have caused the domestic industry’s problems, the chance of success improves substantially from the preliminary phase. Consequently, most foreign companies devote a substantial effort to defending this stage of the proceeding.
