We investigate statistically the characteristics, functioning and incidence of pre-emptive patenting, defined as patent filings whose main effect is to hamper the grant of other patents. Patent applications can be used to prevent the grant of exclusive rights on markets and technologies to others in order to ensure freedom of operation to their holder or keep patent-less competitors out of the market. Combining data from examination outcomes and prior art at the European Patent Office (EPO), we develop a methodology to identify pre-emptive patent applications. We find evidence of pre-emption associated to patent applications cited as compromising patentability while being deemed non inventive. Furthermore, amongst them, those which are withdrawn by the applicant have the strongest pre-emptive power. The coincidence of low inventiveness and high pre-emptive impact supports the idea that some of these patents may be strategically designed by their applicants to block patenting by others.
Facilitating the mobilisation, sharing, or exchange of patents is increasingly important to promote innovation in this globalised and well-networked world, where the circulation of ideas and technologies is essential to innovation. In the context of open innovation, patents are expected to play a role as a means for transferring ideas and technologies from one entity to another, in addition to acting as a means for excluding others from using companies’ own ideas and technologies. In such a situation, a variety of new entities focusing on patent-related transactions are emerging. Some IP specialist firms seek to monetise patents by creating strategic patent portfolios and licensing them. Others provide websites to establish online marketplaces where patents and ideas could be traded. And still others establish a co-operative venture that buys and licenses patents to its members for defensive purpose. They also include IP investment banks that will lend against the value of IP, and firms that seek to create funds, similar to mutual funds, which allow investors to earn revenue from royalties. These new players now could significantly influence the circulation of patents. It would be important for governments to deepen their understanding of how these new players are performing in the patent transaction markets in order to support their development in the most socially beneficial directions. This may also be important for traditional technology-oriented companies, since the effective use of patent transaction markets will help them improve their innovation process and strengthen their competitiveness. Therefore, analysis of the functions, business models, and activities of IP specialist firms is the central topic of this research.
The aim of this report is to provide information and analysis on market developments and pricing in international mobile roaming service (IMRS). While the wireless industry has witnessed spectacular developments in recent years, and is considered competitive in domestic markets, there is a widespread perception among many stakeholders, including some within the industry itself, that IMRS prices are unreasonably and inefficiently high. This report provides comparative information on IMRS retail and, where available, wholesale prices. It also sets out the nature of the perceived problem together with analysis on why IMRS pricing takes the form it does.
This paper discusses issues related to the teaching and assessment of 21st century skills and competencies in OECD countries drawing on the findings of a questionnaire study and other relevant background material such as white papers or curriculum documents. Although all OECD countries were invited to participate in the questionnaire survey, responses were received from seventeen countries or regions, and the paper focuses primarily on this group. The paper presents a short discussion of the importance and relevance of 21st century skills and competencies in the current policy debate and the definitions and conceptual frameworks that have been used in the literature, and proposes a new three-dimensional framework, consisting of the dimensions of information, communication and ethics and social impact. The findings of the questionnaire survey show that most countries or regions cover 21st century skills and competencies in their regulations, guidelines or recommendations for compulsory education. However, there are few specific definitions of these skills and competencies at national or regional level and virtually no clear formative or summative assessment policies for these skills. The only evaluation regarding their teaching is often left to external inspectors as part of their whole school audits. Similarly there are few teacher training programmes that target the teaching or development of 21st century skills, although there exist several teacher training initiatives that focus on developing teachers’ ICT pedagogical skills, most of them optional. The paper discusses the implications of these findings especially with regard to the particular role of ICT in the development of these skills and competencies, and issues related to assessment practices and teacher training.
Les éléments constitutifs du système fiscal belge influe sur le processus de croissance par des canaux différents et à des degrés divers. Les impôts sur la consommation sont parmi ceux qui faussent le moins la croissance et il est tout à fait possible, en Belgique, d’exploiter davantage cette source de recettes fiscales. La taxation différenciée des instruments d’épargne fausse les décisions d’investissement, entravant le redéploiement des capitaux vers leur emploi le plus productif. Cependant, les impôts qui occasionnent le plus de distorsions sont ceux qui frappent le revenu du travail, en raison de leur impact sur les décisions des travailleurs en matière d'emploi. Conscientes de cela, les autorités belges ont cherché à alléger la fiscalité du travail. Cette dernière demeure cependant lourde en comparaison des autres pays, en raison de nombreuses exonérations, qui réduisent les bases d’imposition et nécessitent donc, pour compenser, des taux d’impôt plus élevés. Afin d’améliorer les perspectives des différents groupes sur le marché du travail, on a eu recours largement à des subventions salariales et des réductions de cotisations de sécurité sociale, créant ainsi un système complexe, souvent mal ciblé et visant parfois des objectifs contradictoires. En fin de compte, l’interaction entre l’impôt sur le revenu des personnes physiques, les cotisations de sécurité sociale et le généreux système de prestations a créé une multitude de pièges du marché du travail qui brident l’emploi. Les nouvelles réformes fiscales sont limitées par les problèmes importants et grandissants de viabilité des finances publiques, ce qui signifie que, à moins de procéder à de fortes compressions de dépenses, ces réformes devront s’autofinancer. Pour ce faire, il faut déplacer la charge fiscale vers les sources qui créent le moins de distorsions et élargir les bases d’imposition afin de pouvoir appliquer des taux plus bas. In the years preceding the onset of the global financial crisis, the Central Bank of Russia (CBR) had two goals: to reduce inflation and limit the real appreciation of the rouble. Given the strength of Russia’s balance of payments during the ten years through the first half of 2008, the de facto tight management of the nominal exchange rate resulted in large interventions which were only partially sterilised. As a result, inflation remained persistently high. During the global financial crisis in 2008-09 Russia’s monetary policy was initially constrained by a large degree of private debt dollarisation. After a gradual adjustment of the exchange rate to the new oil price environment which was costly due to reserve losses, the CBR started to lower interest rates and to allow for a somewhat higher degree of exchange rate flexibility. Looking ahead, even greater exchange rate flexibility should be permitted since (i) commodity exporting countries can successfully run inflation targeting and (ii) we find that exchange rate pass-through has been limited and asymmetric and can be taken into account under inflation targeting. Preparations for inflation targeting should focus on a commitment to price stability as the primary goal of monetary policy. At the same time the authorities should enhance their understanding of how monetary developments affect inflation and financial stability and accelerate financial sector reforms aimed at financial deepening.
Individual elements in Belgian tax system affect the growth process through different channels and to a varying degree. Consumption taxes are among the least distortive for growth, and there is considerable scope to increase the reliance on this tax source in Belgium. The Belgian differential taxation of saving vehicles distorts investment decisions, hampering the reallocation of capital towards its most productive use. However, the most distortive Belgian taxes are on labour through their effects on workers’ labour market decisions. Recognising the latter, the authorities have aimed at reducing taxation on labour. However, its level remains internationally high, reflecting numerous exemptions, which reduce tax bases and thus require higher tax rates than otherwise. To promote labour market prospects for individual groups on the labour market, wage subsidies and social security contribution reductions have been used extensively, leading to a complex system, often poorly targeted and at times subject to conflicting objectives. The end result is that the interaction between the personal income tax, the social security contributions, and the generous benefit systems has created a multitude of labour market traps which hold back employment. New tax reforms are constrained by the large and growing fiscal sustainability problem, implying that, unless substantial expenditure cuts are implemented, new tax reforms must be self-financed. This can be achieved by shifting the reliance of the tax system towards the least distortive sources and by broadening tax bases to allow lower tax rates. Along with the recent success of economic growth in the developing world comes more pollution. Reducing these emissions while still enabling these countries to grow requires the use of new technologies in these countries. In most cases, these technologies are first created in high-income countries. Thus, the challenge for environmental policy is to encourage the transfer of these environmentally-friendly technologies to the developing world. This paper reviews the economic literature on both the creation and transfer of environmental technologies, with an emphasis on how the development of new technologies in leading economies can lead to environmental improvements in developing countries. I begin by discussing the incentives for environmentally-friendly innovation, which occurs primarily in developed countries. I then review the literature on the transfer of these technologies to the developing world. A key point is that technology diffusion is gradual. Early adoption of policy by developed countries leads to the development of new technologies that make it easier for developing countries to reduce pollution as well. Globalization also plays an important role in moving clean technologies to developing countries. Since clean technologies are first developed in the world’s leading economies, international trade and foreign investments provide access to these technologies. Finally, the absorptive capacity of nations is important. The technological skills of the local workforce enable a country to learn from, and build upon, technologies brought in from abroad. I conclude by discussing the implication of these lessons for policy, focusing on three examples pertaining to climate change: the Clean Development Mechanism, the role of intellectual property, and government-sponsored R&D.
This report provides a comparative perspective on the application of quality regulation principles to financial sector regulators, in the US, Canada, Australia, the UK and France. The report compares key provisions of the codes of the Basle Committee and IOSCO, with the OECD's 2005 Guiding Principles for Regulatory Quality and Performance, and the 2009 Policy Framework for Effective and Efficient Financial Regulation (PFEEFR). The report analyses the independence and accountability of the regulators, as well as their powers. The analysis focuses on requirements for ex ante and ex post regulatory impact analyses, including burden reduction; for transparency and communication of decision making, as well as co-ordination and regulatory review; for improving the regulatory system over time and for regulating conflicts of interest. The report finds variation in the formal arrangements, and respective practices. It also finds that the requirements related to better regulation principles are often implemented too late in the decision-making process when regulations are set at the international level.
The international discussion about global climate change now revolves around what the necessary set of policies and technologies will be needed to realize reduction goals. Stabilizing atmospheric carbon dioxide (CO2) concentrations at 450 to 550 parts per million will require policy changes along with innovation and large-scale adoption of GHG-reducing technologies throughout the global energy system. Innovations will need to be supported by international cooperation and behavioral changes to further realize the benefits of technological advances. Much discussion has therefore focused on policies that target technology directly, including research and development (R&D) activities and technology-specific incentives, as well as policies and agreements that increase diffusion and adoption. This paper reviews the recent literature on trends and prospects for innovation in climate change mitigation, to identify the most important international and domestic actions necessary to technologically alter energy systems in a direction that can achieve GHG stabilization targets while also meeting other societal goals. It provides an overview of key technical issues associated with the development, diffusion, and adoption of technologies that mitigate climate change. It examines the role of environment and innovation policy measures to encourage innovation, and it outlines the conditions that trigger these advances. The review highlights that establishing a GHG emission price is essential from a technology perspective. Such a price should be coupled with public R&D support. The review discusses policy features that impact on environmentally oriented R&D, the diffusion of environmental innovations, their deployment in developing countries. In particular, the paper outlines the positive role of international technology-oriented agreements as part of the architecture of an international climate change policy.

La réduction des émissions liées à la déforestation et à la dégradation des forêts (REDD) dans les pays en développement est un nouveau mécanisme financier proposé pour le régime climatique post-2012 sous l'égide de la Convention-cadre des Nations Unies sur les changements climatiques (CCNUCC). L’obtention d’un accord sur un futur mécanisme de REDD constituerait un progrès majeur et sans précédent vers la création d’un dispositif international visant à internaliser les services écosystémiques forestiers liés au carbone, et pourrait sensiblement contribuer à relever le défi du changement climatique global. Les forêts jouent également un rôle essentiel pour assurer la biodiversité, et pour fournir d’autres services écosystémiques non liés au carbone. Le plan d’action de Bali reconnaît que l’action en faveur de la REDD « peut avoir des retombées positives et servir les buts et objectifs d’autres conventions et accords internationaux pertinents ». Un exemple notable est celui de la Convention sur la diversité biologique. Le présent rapport examine les moyens de renforcer les avantages connexes pouvant être tirés de la REDD sur le plan de la biodiversité, tant au niveau de la conception qu’à celui de la mise en oeuvre. Il analyse les répercussions potentielles sur la biodiversité des différents dispositifs de REDD envisageables qui ont été avancés dans les négociations internationales sur le changement climatique et poursuit en examinant comment compléter la REDD en créant des incitations supplémentaires spécifiquement axées sur la biodiversité, de manière à cibler directement les avantages liés à celle-ci. Les principaux aspects de la conception d’un mécanisme de REDD sur lesquels il reste à trouver un accord, et qui sont susceptibles d’avoir des répercussions sur la biodiversité, sont notamment la portée du mécanisme, son financement, les niveaux de base ou de référence, la permanence, etc. Par exemple, une approche du financement de la REDD s’appuyant sur le marché (plutôt que sur un système de fonds) permettra vraisemblablement d’obtenir des ressources financières beaucoup plus importantes (en mobilisant directement le secteur privé), d’où un plus grand volume d’activités de REDD, une superficie accrue des zones forestières conservées, et par conséquent des avantages connexes plus importants en termes de biodiversité. Dans l’ensemble, un mécanisme de REDD bien conçu sera susceptible de procurer des avantages connexes substantiels sur le plan de la biodiversité, dans la mesure où le ralentissement de la déforestation et de la dégradation contribue nécessairement à freiner la destruction des habitats et par conséquent la perte de biodiversité. Toutefois, certains des aspects de la conception d’un mécanisme international de REDD peuvent présenter des risques potentiels pour la biodiversité, par exemple les activités de boisement et de reboisement qui aboutissent à des mono-plantations, aussi peut-il être nécessaire de prévoir des mesures de sauvegarde appropriées.

This study focuses on the single most important component of the private return on tertiary education, the gross wage premium. There are at least two additional reasons for paying particular attention to wage premia. First, the wage premium earned by existing graduates is easy to observe, so high-school leavers can be assumed to take it into account when deciding for or against enrolment in tertiary education. Second, to the extent that wages reflect marginal labour productivity, estimates of wage premia are sometimes used to assess the quality of human capital in an economy with a view to correcting simpler measures based on years of schooling or attainment levels.

Educational outcomes are shaped by a wide range of factors, including innate students’ characteristics, family and school background and other environmental factors. But a key-question for policy-makers is what schools and school policies can do to raise overall student performance. Several studies have indeed shown the positive effect of an increase in cognitive skills and competencies on both social and individual economic welfare. From a macroeconomic viewpoint, international differences in student achievement tests have been shown to increase long-run economic growth. Our analysis focuses on the quality of school systems, i.e. on the association of educational policies with average learning outcomes.

Cities are part of the climate change problem, but they are also a key part of the solution. This report offers a comprehensive analysis of how cities and metropolitan regions can change the way we think about responding to climate change. Cities consume the vast majority of global energy and are therefore major contributors of greenhouse gas emissions. At the same time, the exposed infrastructure and prevalent coastal location of many cities makes them common targets for climate change impacts such as sea level rise and fiercer storms. This report illustrates how local involvement through ?climate-conscious? urban planning and management can help achieve national climate goals and minimise tradeoffs between environmental and economic priorities. Six main chapters analyse the link between urbanisation, energy use and CO2 emissions; assess the potential contribution of local policies in reducing global energy demand and the trade-offs between economic and environmental objectives at the local scale; discuss complementary and mutually reinforcing policies such as the combination of compact growth policies with those that improve mass transit linkages; and evaluate a number of tools, including the ?greening? of existing fiscal policies, financing arrangements to combat climate change at the local level, and green innovation and jobs programmes. One of the main messages of this report is that urban policies (e.g. densification or congestion charges) can complement global climate policies (e.g. a carbon tax) by reducing global energy demand, CO2 emissions and the overall abatement costs of reducing carbon emissions. To inform the groundswell of local climate change action planning, the report highlights best practices principally from OECD member countries but also from certain non-member countries.
Ce document de travail porte sur l’état actuel des relations budgétaires entre les différents niveaux d’administration en Belgique ainsi que sur la manière dont celles-ci ont évolué au fil du temps. Partant du constat que le système qui donne corps au fédéralisme budgétaire est source de déséquilibres entre l’administration fédérale et les échelons infra-fédéraux (déséquilibre vertical) de même qu’entre les différentes entités fédérées (déséquilibre horizontal), les auteurs esquissent des orientations pour l’améliorer. Faute de réformes, le déséquilibre vertical ne fera que s’accentuer dans la mesure où la charge budgétaire imposée par le vieillissement de la population grèvera principalement le budget fédéral. Aussi la réforme devra-telle viser à renforcer la capacité budgétaire de l’administration fédérale en améliorant ses sources de recettes et en faisant basculer la charge représentée par certaines dépenses obligatoires sur les entités fédérées. Le déséquilibre entre régions résulte du manque de cohérence entre fiscalité et dépenses. Les recettes partagées provenant de l’impôt sur le revenu des personnes physiques sont attribuées à la région de résidence tandis que la région du lieu de travail n’en bénéficie pas, ce qui pénalise particulièrement la région de Bruxelles-Capitale en termes de recettes. Cette anomalie pourrait être corrigée en attribuant à la région du lieu de travail une proportion plus élevée des recettes partagées de l’impôt sur le revenu des personnes physiques. Par ailleurs, il conviendrait de réorganiser le système des subventions de péréquation afin d’inciter les régions bénéficiaires à développer leurs propres sources de recettes fiscales. La performance du système budgétaire pourrait être encore améliorée si l’on réussissait à accroître l’efficience des dépenses dans les domaines d’intérêt national qui sont du ressort des entités fédérées ou dans lesquels on observe un chevauchement de compétences, qu’il s’agisse des politiques de l’emploi, de la R-D, de la formation, de l’éducation, de l’énergie et de l’environnement.

This paper examines the current academic and policy literatures concerning school evaluation in primary and secondary education within the OECD countries. First, it provides a typology of the existing systems of school evaluation across the OECD. It encompasses the diverse criteria and instruments commonly used to carry out schools evaluation, as well as the players involved in the design and implementation of school evaluation. It also describes potential consequences for schools. Second, this paper analyses how school evaluation schemes are interrelated with other components of the evaluation framework, such as teacher evaluation and system evaluation. The potential complementarities, duplication and inconsistency of objectives stemming from these interrelations are discussed. Third, this paper presents the advantages and drawbacks of different approaches to school evaluation, the resistance and implementation difficulties resulting from misalignment of interests between different stakeholders, and possible ways to overcome impediments to implementation. Finally, it reviews the quantitative and qualitative evidence available on the impact of different school evaluation schemes on school performance, student learning and the incentives for the teaching staff. It concludes by considering the circumstances under which school evaluation schemes seem to be more conducive to school improvement. The effectiveness of school evaluation schemes relies on developing competencies for evaluation and for using feedbacks. Alignment of stakeholders' interests is also critical to have the support of those being assessed.
This paper uses the OECD’s indicators of product market regulation (PMR) to assess the extent to which the regulatory environment in Russia supports competition and to draw attention to the areas where further reform efforts would pay dividends. The indicators show that, despite improvements in some areas, many aspects of Russia’s regulatory framework are still restrictive, which provides considerable scope for reaping gains from bringing regulation into line with international best practice. In particular, the scores suggest that Russia’s economic performance would greatly benefit from a reduction in the role of the state enterprise sector in markets that are inherently competitive and reinvigorated efforts to liberalise foreign trade and direct investment regimes. In some network sectors, recent regulatory changes have significantly improved the scope for competition. However, ongoing work needs to focus on separating competitive and monopoly market segments and eliminating barriers to entry. In addition, the authorities need to develop the capacity and strengthen the hands of the sectoral regulators. Introducing an overarching competition policy would also help bring the issue of competition to centre stage and spread a competition ethos through different levels of government.
The paper discusses the current state of fiscal relations across levels of government in Belgium and how it has developed over time. As the current system of fiscal federalism is creating imbalances between the federal and the sub-federal governments (vertical imbalance), and between sub-federal governments (horizontal imbalance) the paper also suggests directions for improvements. Without reform, the vertical imbalance will widen as the fiscal burden from the ageing of the population falls mainly on the federal level. Reform should therefore strengthen the fiscal capacity of the federal government by improving its revenue sources and by shifting some spending obligations to sub-federal governments. The imbalance between regions arises because of the lack of coherence between taxation and spending. Shared revenues from the personal income tax are allocated to the region of residence, while the region of the workplace does not benefit, which particularly affects Brussels’ revenue level. This imbalance could be eliminated by allocating more of the shared personal income tax to the region of the workplace. Furthermore, the system of equalisation grants should be re-designed to provide incentives to the recipient regions to develop their own revenue base. The performance of the fiscal system could further be improved by raising the efficiency of spending in areas of national interest, which have been assigned to sub-federal governments or where there are overlapping responsibilities, such as in employment, R&D, training, education, energy and environmental policies.

It is a dynamic time for the nuclear power sector. Existing reactor control rooms are undergoing various forms of modernisation. New reactors are being built in many countries and advanced reactors are being designed through international co-operation to support power generation for decades to come. The new technologies and concepts that are being considered in this context could impact upon the roles of the plant operators and thus plant safety. It is therefore important that the potential implications – both positive and negative – are evaluated and understood.

Through this technical opinion paper, the NEA Committee on the Safety of Nuclear Installations (CSNI) has sought to identify a set of research topics that should be explored in order to enhance knowledge of the human and organisational factors concerned. Research to address the topics described in this paper will provide the technical basis to help ensure that the benefits of new technology are realised and that the potential negative effects are minimised.

This paper should be of particular interest to research organisations and other stakeholders (including regulatory agencies, international organisations and industry organisations) that could support this research and benefit from its results.
